INTRA-EU TRADE IN BLUETONGUE SUSCEPTIBLE ANIMALS - COMMISSION REGULATION (EC) No 1266/2007 COUNCIL DIRECTIVE 90/425/EC

THE ANIMALS AND ANIMAL PRODUCTS (IMPORT AND EXPORT) (ENGLAND) REGULATIONS 2006

This note is to advise you of Defra's enforcement policy for the legislation cited above.

We are currently at a stage in our bluetongue outbreak where strenuous efforts are being made to contain the disease to the part of England currently defined by the protection zone. This strategy must not be undermined by the introduction of infected animals to the surveillance zone or free area in the UK i.e. as has been the case in the recent incidents of infected animals being imported to Middlesbrough, Worcester and Kirkcudbright.

As a consequence, all consignments of sheep, cattle and other ruminants from Continental Europe are being checked and tested shortly after arrival at destination by Animal Health. When deficiencies are found then corrective action will be taken in accordance with the legislation and consideration will be given to prosecuting any offences committed. You should note that consignees, importers and the person in charge of the animal, if different, all have a responsibility to ensure that the Regulations are complied with.

In any event, if an animal is found to be infected then powers exist to require it to be destroyed. This has already been done in the three recent cases and will be done again if necessary to prevent the spread of disease. No compensation is payable under such circumstances and the consignor, his representative and the person in charge of the animal may be jointly and severally liable for any reasonable expenses arising out of the exercise of such powers.

The regulations set out for the import of animals from Bluetongue restricted zones reduce the risk of moving infected animals, but do not eliminate it completely. Therefore all concerned, including farmers, import agents and transporters should take great care when importing any livestock from areas affected by bluetongue and ensure that the necessary insecticide treatment, vector protection, testing and certification has been carried out rigorously in order to protect both their own interests and that of the wider livestock industry.
